STEM CELL LEGISLATION REQUIRES CLARITY OR IT WILL BE INEFFECTIVE
OTTAWA, June 3, 2002 (LSN.ca) - The stinging criticism of the proposed Canadian stem cell legislation issued last week by leading international expert Dr. Dianne Irving, shows bill C-56 to be toothless according to legal opinion. Richard Marchak, a lawyer with Campaign Life Coalition told LifeSite that the current incorrect and incomplete definitions in the bill would leave loopholes rendering the prohibitions unenforceable.
"Since the legislation allows for jail terms and large fines, the courts would be hard pressed to issue penalties based on ambiguities on what is prohibited and what is not," said Marchak. Dr. Irving, whose Ph.D. included a doctoral concentration in secular bioethics at the world's foremost bioethics institute, noted that the bill was poorly prepared using faulty science and lacking basic definitions necessary to have the law actually ban cloning as it claims it does.
In terms of human cloning, which the bill is said to ban, Irving notes that at least eight varieties and techniques are not mentioned and are therefore not prohibited. The one technique that is mentioned, Somatic Cell Nuclear Transfer (SCNT) is inaccurately described. Therefore, in Irving's opinion, it too would not be prohibited. The Bill can be interpreted as not prohibiting any form of human cloning.
