CHRISTIAN PRINTER CONSIDERS APPEALING COURT RULING ON RELIGIOUS FREEDOM
Brockie is out of pocket about $100,000 for legal costs and must still pay $5,000 fine to gay group
TORONTO, June 26, 2002 (LSN.ca) - Scott Brockie, the Christian printer who was embroiled in court cases over refusing a printing job for a homosexual activist organization, is considering appealing the June 17 ruling in his case. The ruling has caused considerable debate among Christians some of whom argue that the judgement represents a significant step forward for freedom of religion and others contending that the ruling has diminished religious rights.
While the ruling did say that Brockie would not have to print material promoting homosexuality, it did say that he could not refuse to print items such as letterhead and business cards for the homosexual activist group. Moreover, the ruling did not revoke the $5,000 fine Brockie was ordered to pay to the homosexual activist group by the Ontario Human Rights Tribunal.
The decision runs counter to the intervention of the Canadian Civil Liberties Union (CCLU) in the case which argued on Brockie's behalf. CCLU lawyer Andrew Lokan argued that business persons should not be able to discriminate against a person but should be able to discriminate against a cause. Observers have suggested that if the organization applying for printing were a white supremist group rather than a homosexual activist group, the sentiments surrounding the ruling in the case would be much different. Christianity holds reprehensible both the promotion of homosexuality and the promotion of racism.
The deadline for a decision on appealing the ruling is July 2. Brockie told LifeSite that unfortunately one of the considerations in taking the case further would be finances. Despite having had significant donations to his defense fund, Brockie is out of pocket approximately $100,000 after this long ordeal which began April 1996 when he refused the printing request.
