For Life Prior to 1969, abortion was illegal in Canada subject to the defence of necessity. On May 14th, 1969, the abortion law was liberalized to include the mother's "health." Health was interpreted as a state of complete physical, emotional and social wellbeing and not merely theabsence of disease or infirmity, thereby allowing abortion for any reason. On January
28th, 1988 the Supreme Court of Canada struck down this open-ended law,
(Section 251 of the Criminal Code) leaving Canada as one of only three
countries in the world where abortion is unregulated by law. Abortions
may now be performed for any reason throughout the entire nine months
of pregnancy. A woman who considers abortion should be offered information about her developing baby. She should know all the facts about the "procedure," the risks and the alternatives. Most women are not told that they can suffer many immediate and long-term physical, emotional and/or pyschological side effects. She should also know that there are places to turn for assistance.
The first right enshrined in the 1982 Charter of Rights and Freedoms is the right to life of every person. However, within Canadian law, the child waiting to be born has been denied its humanity and its personhood. In this third
millennium, it's time that Canadian laws reflect scientific knowledge
of the 21st century.
